يتناول هذا البحث دليل نيوبورت لقانون النزاعات المسلحة البحرية بإصدارَيه لعامَي ٢٠٢٣ و٢٠٢٥، وهو أحدثُ جهدٍ فقهيٍّ جماعيٍّ في هذا الفرع، وأوّل مصنّفٍ يقصُر دوره على تبيين القانون النافذ. فقانونُ النزاعات المسلحة البحرية فرعٌ عريقٌ بأصوله العرفية، لكن لم يكتمل له إطارٌ تعاقديٌّ جامع، فبقي محكوماً بالعرف وبممارساتٍ متباينة، ممّا أفسح المجال للخبراء القانونيين بالاجتهاد لتقديم قواعده في صورةٍ منظّمة على شكل أدلّةٍ عدّة، ومنها دليل نيوبورت (بإصدارَيه ٢٠٢٣ و٢٠٢٥) الذي ينفرد بحسب زعمه بمنهجٍ يقتصر على تقرير القانون القائم، دون اقتراح القانون المنشود أو إنشائه، خلافاً لسلفه دليل سان ريمو لعام ١٩٩٤ الذي جمع بينهما. ويثير هذا المنهج حين يُطبَّق على المسائل الأشدّ خلافاً في هذا الفرع، إشكاليةً في العلاقة بين وصف القاعدة القائمة وتكوينها، إذ قد ينقلب التبيين في مثل هذه المواضع من وصفٍ محايدٍ إلى تشكيلٍ للقاعدة القانونية يوجّهها وجهةً بعينها تحت دعوى تقرير ما هو كائن.
