Legal Methods of Notifying Litigants Under the Civil Procedure Law

Abstract

Judicial notification is a fundamental pillar of justice and fair trials, serving as the legal means of informing litigants of judicial proceedings against them and enabling them to exercise their right to defense and appear before the courts. This research aims to clarify the concept and importance of judicial notification in litigation and analyze the legal provisions governing its methods under the Code of Civil Procedure, using the comparative analytical approach. The study concludes that valid notification is essential for the validity of litigation, as it legally informs the defendant of the case filed against them and provides an opportunity to defend their rights. Invalid notification may lead to the invalidity of subsequent procedures affected by it. Moreover, procedural time limits for appealing or enforcing judgments begin on the date of valid notification, strengthening litigation safeguards and promoting judicial stability.
