Environmental Pollution Offences and the Iraqi Legislature's Attitude Towards Them

Abstract

Environmental pollution in Iraq represents a strategic challenge threatening fundamental life components, with its devastating effects amplified by unregulated industrial and oil practices, environmental consequences of successive wars, and unplanned urban and industrial expansion. Despite existing legislative provisions in the Iraqi Constitution, Environmental Protection and Improvement Law No. (27) Of 2009, and penal references in the Penal Code, the current legislative system suffers from structural and procedural gaps that undermine its capacity to confront these dangers.

The central problematic lies in the evident gap between the theoretical legislative framework and practical implementation on the ground, where structural challenges intensify, including inefficiency of specialized personnel, widespread environmental illiteracy, and ineffectiveness of monitoring mechanisms. Legislative deficiency also manifests in failure to keep pace with rapid developments in environmental crimes, coupled with weak stipulated penalties that are disproportionate to the severity of damages resulting from environmental pollution in its various forms.

Specialized legal analysis demonstrates that environmental crime is based on a material element represented by the polluting act, resulting damage, and causal relationship, and a moral element requiring proof of criminal intent. The Iraqi Penal Code has addressed pollution crimes in scattered texts such as Articles 412, 479, and 496, while the Environmental Law has focused on regulating preventive, monitoring, and procedural provisions.

The findings confirm that addressing this dilemma requires comprehensive reform of the legal system through bridging legislative gaps, enhancing environmental monitoring and inspection mechanisms, building institutional capacities, disseminating environmental awareness among various societal segments, and achieving integration between economic development requirements and environmental protection necessities to ensure sustainable development that preserves the rights of current and future generations to live in a healthy and secure environment.
